Thanks to the expert guidance of Ubuntu's Mary , my family and I now have a different, delightful story about our Canada journey.
I, along with my daughter, had accompanied my wife who was traveling to study in Canada, the implication being that my wife had to be the propeller for the rest of the family towards status retention/extensions, as well as Permanent Residence. Mary relentlessly looked out for alternative pathways and opportunities, never giving up even when we were going to. I became the principal applicant for our PRs, and Ubuntu handled everything. As of today, August 26, 2026, with my wife completing her studies only 2 months ago, we are now Permanent Residents of Canada. Express Entry and Permanent Residence Refusals

A permanent residence refusal after an Invitation to Apply is uniquely painful, because the applicant has usually already restructured their life around the expected outcome. These files demand precision.

Four routes after a refusal

Choosing the wrong route wastes months and money, and can quietly close doors that were still open. Here is what each one actually involves

Fastest route  |  No tribunal  |  1 to 4 months

A reconsideration request asks the deciding visa office to reopen and re-decide your application without you filing an entirely new one. It is not an appeal, and there is no legal obligation on the officer to reconsider, which means the submission has to earn its outcome on the strength of its reasoning.

Reconsideration works best in a narrow set of circumstances: a document that was submitted but not considered, a factual error on the face of the decision, a misapplied policy, or a material change in your circumstances that occurred before the decision. It rarely works when the request simply asks the officer to weigh the same evidence differently.

  • Best filed within thirty days of the refusal, while the file is still readily accessible to the office
  • Should be accompanied by a written legal submission, not a bare email
  • Does not stop you filing a fresh application in parallel where that is strategically sound
  • Costs a fraction of an appeal and carries no government filing fee

For the majority of temporary residence refusals, the strongest and most reliable route forward is a new application that has been deliberately rebuilt to answer every concern the officer raised. Canada imposes no waiting period before re-applying, which is both an opportunity and a trap.

The trap is that applicants re-submit substantially the same package, sometimes within days, and receive an identical refusal. Each repeat refusal makes the next application harder, because the pattern itself becomes part of your immigration history. A rebuilt application is not a resubmission. It is a different file.

The Immigration Appeal Division is an independent tribunal of the Immigration and Refugee Board of Canada. Where a right of appeal exists, the IAD is powerful, because it conducts a hearing de novo. It hears new evidence, it hears you and your witnesses testify, and it substitutes its own decision for the officer's.

Appeal rights are most commonly available in refused family class sponsorships, in residency obligation determinations for permanent residents, and in certain removal orders. Economic class permanent residence refusals and temporary residence refusals generally do not carry IAD appeal rights.

  • The deadline to file is short, commonly thirty days, and the Division applies it strictly
  • Many sponsorship appeals resolve early through Alternative Dispute Resolution without a full hearing
  • The IAD may grant relief on humanitarian and compassionate grounds even where the legal test is not met
  • Thorough witness preparation is the single largest determinant of outcome at hearing

Judicial Review is an application to the Federal Court of Canada asking it to review the lawfulness of an immigration decision. It is available for almost every immigration decision, including those with no right of appeal, and it is the correct route where an officer acted unreasonably, ignored evidence, or denied you procedural fairness.

It is important to understand what Judicial Review is not. The Court does not re-decide your application and does not accept new evidence. If leave is granted and the application succeeds, the usual remedy is that the decision is set aside and your file is returned to a different officer for a fresh decision.

  • Leave must be sought within fifteen days for decisions made inside Canada and sixty days for decisions made outside Canada
  • Leave is discretionary and a substantial proportion of applications do not proceed past that stage
  • A licensed lawyer must appear before the Federal Court. We coordinate with counsel and prepare the underlying record
  • Many files settle by consent before hearing where the Department agrees the decision was flawed

Questions people ask after a refusal

For temporary residence applications there is no mandatory waiting period. You may legally file a new application the day after a refusal. Whether you should is a different question entirely.

Re-applying without materially changing the file almost always produces a second refusal, and repeat refusals accumulate on your immigration record in a way that makes each subsequent application harder to approve. Our advice is consistent: obtain the GCMS notes, understand precisely what the officer was not satisfied about, remediate it, and only then re-file. The exception is where misrepresentation has been found, in which case a bar applies and re-applying during that bar is itself a serious problem.

The Global Case Management System is IRCC's internal case file. The refusal letter you receive is a template with checkboxes. The GCMS notes are the officer's actual working record: their assessment, their concerns, the documents they reviewed, the internal correspondence, and often the specific sentence that decided your case.

Without the notes, any response is guesswork. With them, the response is targeted. Notes are obtained through an Access to Information and Privacy request and typically take about thirty days, which is why we file that request the day we open your file rather than waiting.

No. A refusal is a decision on one application based on the evidence before one officer on one day. It becomes part of your history and must be disclosed truthfully on every future application, but it does not disqualify you.

What does cause lasting damage is a finding of misrepresentation, which carries a five year inadmissibility, or a pattern of repeated identical applications that signals to officers that the underlying concern was never addressed. Both are avoidable with proper strategy.

It depends entirely on the category. Refused family class sponsorships, residency obligation decisions affecting permanent residents, and certain removal orders generally carry a right of appeal to the Immigration Appeal Division. Study permits, work permits, visitor visas, and economic class permanent residence refusals generally do not.

Where no appeal right exists, that does not mean you are without recourse. Reconsideration, a rebuilt application, and Judicial Review at the Federal Court all remain available, and one of them is almost always appropriate.

The initial case review is free and carries no obligation. Beyond that, fees depend on the route. A reconsideration submission, a rebuilt application, an IAD appeal, and a Judicial Review are very different pieces of work. You receive a written retainer with a fixed fee before any work begins, and there are no hidden charges.

We do not guarantee outcomes, and you should be cautious of anyone who does. Canadian law prohibits guaranteeing an immigration result, because the decision belongs to IRCC or the tribunal, not to your representative. What we do commit to is an honest assessment of your prospects before you spend anything, including telling you when we believe a case should not proceed.

You are legally entitled to represent yourself at every stage, and some applicants do so successfully. The difficulty is that the material questions are technical: which route preserves your options, what the officer is actually required to consider, how the evidentiary burden is allocated, and what a tribunal will find persuasive.

Deadlines are also unforgiving. A missed fifteen day Judicial Review window or thirty day appeal window generally cannot be recovered. If you intend to proceed alone, we would still encourage you to take the free review so that at minimum you know your deadline and your realistic options.

Treat this as urgent. Section 40 of the Immigration and Refugee Protection Act deals with misrepresentation, and a finding under it ordinarily results in a five year bar on entering Canada and can affect family members.

If you have received a procedural fairness letter, the finding has not yet been made and your written response within the stated deadline is the most important document in your file. If the finding has already been made, Judicial Review or, in some circumstances, an application for authorisation to return to Canada may be available. Do not file any new application until this has been assessed. Contact us the same day.
